General conditions of Sale

ART. 1 – GENERAL PROVISIONS

1. By browsing this area, the user accesses the e-commerce site “Il Ruzante – Studio d’Antiquariato” di Lusardi Luisa (“Il Ruzante”), accessible via the url: www.ilruzante.com. Browsing and transmitting a purchase order on the website implies acceptance of these General Conditions of Sale (the “Conditions”) and the Privacy Policy.

2. All the works presented on this website are sold directly by:

ART. 2 – WORKS OFFERED

1. Il Ruzante sells works of art and antiques.

ART. 3 – AVAILABILITY OF THE WORKS

1. The availability of the works refers to the availability of the same when the customer places an order. However, this availability must be considered as purely indicative since, due to the simultaneous presence on the site of multiple users, the works may have been sold to other customers before the order has been confirmed.

2. Even after sending the order confirmation e-mail, there may be cases of partial or total unavailability of the works. In this case, the customer will be informed by e-mail and the order will be rectified.

ART. 4 – CONCLUSION OF THE CONTRACT (Legislative Decree 70/2003)

1. To make a purchase, the customer must enter the selected works in the “cart”, fill out a special order form and click on the “Place Order” button.

2. The sales contract is considered concluded following the sending by “Il Ruzante” to the customer of an e-mail confirming the order. The e-mail contains the following information: customer data, details of the purchased works and their number, price of the purchased works (without indication of the VAT, for the particular “regime del margine” to which the sale of antique works of art is subject), the shipping costs and the total of the transaction, delivery times and the link to be able to print and archive the copy of these Conditions.

3. The customer undertakes to verify that the personal data contained in the e-mail mentioned in Article 4 paragraph 2 are correct and to promptly notify Il Ruzante of any corrections / changes to be made.

ART. 5 – DELIVERY OF WORKS

1. Il Ruzante accepts orders to be delivered in the Italian territory, in the European Union and throughout the world. The works will be delivered by courier to the address indicated by the customer within the estimated time, which depends on the type of work and destination. For deliveries to Italy and the European Union, the time normally does not exceed 15 working days. For deliveries to other countries, the time depends on the destination country. For works destined abroad that require the Nulla-Osta of the “Soprintendenza” (older than 70 years and with a value of more than € 13,500), delivery depends on the response time of the Soprintendenza and normally does not exceed 60 days.

2- It will be possible for the customer to select the “Collect in Gallery” option. The order will be available for collection from the day following the purchase and, in exceptional cases, within 7 (seven) days from the date the order confirmation e-mail is sent to the customer. ART. 6 – METHOD OF PAYMENT, PRICES AND DELIVERY COST

1. Payment can be made by the customer through the following payment methods:

– PayPal

– Credit card (via PayPal)

2. The user is required to ascertain the final sale price before submitting the related order. The obvious material error reported in the price on the site entails the right of Il Ruzante not to confirm the shipment and to proceed with the immediate reimbursement of the purchase value paid by the customer without the latter being able to make any exceptions in this regard.

3. The selling prices of the works on the site are expressed in euros, inclusive of VAT (not split for the application of the “Regime del Margine”) and do not include shipping costs. The cost of shipping is highlighted at the time of finalizing the order and before payment. For works that require the Nulla-Osta of the Superintendency, the price of the expenses for obtaining the Nulla-Osta and for shipping will be communicated within 15 working days and only then can the Customer be able to finalize the order with the contextual payment. Any duties imposed by the country of destination will always be charged to the customer and must be paid at the same time as the order.

4. By selecting the “Collect in Gallery” option, no shipping costs will be applied to the customer.

5. The Ruzante will process the purchase order only after receiving confirmation of the authorization to pay the total amount due, consisting of the purchase price, shipping costs and any additional costs.

6. Delivery will be made by courier within the estimated times. Shipping times are valid from the moment the order is entrusted to the courier, please consider that external factors such as courier delays, logistical problems, adverse weather conditions or the inability to access the address indicated, may affect the punctuality of delivery. Upon delivery, you must check that the package / container is perfectly closed and the seal intact. It will always be necessary to check the contents immediately and to oppose any damage found to the courier.

ART. 7 – TAX DOCUMENTATION

1. Being a B2B e-commerce, Il Ruzante will always issue a regular electronic invoice for each sale. The paper invoice will accompany the shipment of the work and at the request of the buyer it can be sent in advance by e-mail to the address indicated.

2. For the correct issue of the invoice, the customer must always provide the following information: name, complete address, tax code, VAT number (Italy and the European Union), SDI code or PEC (for Italy), while for other countries, the relevant tax information for that country must be indicated.

ART. 8 – RETURNS, DISPUTES AND COMPLAINTS

1. The works, unless otherwise specified, are ancient and therefore unique as such. For this reason they are in no way replaceable. As this is a B2B e-commerce, returns are not accepted by Il Ruzante.

2. The descriptions on the site represent only the opinion of the Gallery and may possibly be subject to revision. The statements regarding the author, the attribution, the origin, the period, the provenance and the conditions of the works described on the site are to be considered as a personal opinion of our experts, any scholars consulted and not. a fact. In any case, the published image prevails over the description and its translations.

3. Although the Gallery has put the utmost diligence in indicating the dimensions, these must always be understood as non-binding.

ART. 9 – ASSISTANCE TO THE BUYER

We will be available to our buyers to provide all information and clarifications on the works exhibited on the site.

ART. 10 – LIABILITY

1. Il Ruzante assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet, in the event that it fails to execute the order within the time stipulated in the contract .

ART. 11 – COPYRIGHT

1. Brands, logos and other distinctive signs on the site belong to their respective owners. The use of trademarks, logos and other distinctive signs is prohibited, including reproduction on other websites by unauthorized third parties. All the contents of the site are protected by copyright (texts, images and graphics).

ART. 12 – DATA PROCESSING

1. The processing of the customer’s personal data takes place in compliance with the regulations in force regarding privacy and protection of personal data, with particular reference to the provisions of EU Regulation 2016/679 (“GDPR”).

2. Il Ruzante is the data controller of the customer’s personal data processed for the purpose of completing and executing the Contract. The duration of the processing is strictly connected to the contractual object; the data will be processed according to the purposes of the contract, functionally to the performance of the contractual object and the legal obligations, in accordance with the privacy policy issued by Il Ruzante and available on the Site.

ART. 13 – COOKIES

1. The site uses cookies to ensure normal navigation and the use of its features. For more information about the cookies used by the Site, customers can consult the information in the Cookies section.

ART. 14 – UPDATING OF THE CONDITIONS OF SALE

1. Il Ruzante reserves the right to make, with or without notice, modifications or improvements to the services, contents and any other information referring to the website, including these conditions of sale.

2. Users are therefore advised to regularly check the website and its conditions of sale.

ART. 15 – APPLICABLE LAW AND JURISDICTION

1. These General Conditions of Sale are subject to Italian law.

2. As this is a B2B e-commerce, any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of Brescia, seat of the gallery.
